I'm going to be completely honest with you, I don't think either of the parties involved in this are right.

She's not right for essentially copying your work without permission and not noting you as a reference. You're not right for labeling what appears to be a child a malicious thief, berating her on another site and comment flooding her.

It's easy enough to say "GOD, why don't they get their own style, you know?!" but /everyone/ establishes their own by emulating other artists first. You can't walk before you crawl. I learned to draw by copying the entries for the "Beauty Contests" on Neopets when I was like six or seven years old.

Would it be any different if she played around with these drawings in her own home in private? It's technically still copying your art. Or are you concerned that she's getting all the credit?

I understand completely why you don't want people jacking your work. You're legally entitled to not have that happen. I am concerned for the immature way you reacted, however.

I'm all for people learning by emulating, I did so as well when I was younger, so I understand where you are coming from, Hazel. I think though that the issue here is not that it's copied work so much as that it's infringing on the copyright of a site whose success is largely dependent on that artwork. As a site owner myself, I would work just as hard to remove this kind of obvious copying if it had happened to artwork from my site -- not because I'm worried about someone else getting credit (I didn't draw most of the art on my site, anyway), but because I paid money for that artwork out of my site's funds, and it is copyrighted under my website. Cases of copying such as this would be harmful to my site and my business, because sim games are so dependent on the visual "branding". If suddenly my branding is all over the web, or no longer looks unique, that harms my ability to compete in the market and create a unique look/name for myself. As in this case, EX's dinosaur artwork represents the site overall, so if it starts cropping up everywhere than it is creating a negative impact on the site's branding. Hopefully that makes sense XD

I think a lot of times owners are seen as overreacting in cases like this because normally, yeah, probably not as big of a deal, but when it's part of your site it becomes more than just artwork, it's an asset of your business and something that either you have paid large amounts of money for or your business has paid for through the investments of your players.

I see where you're coming from, Hydra, and that's why I recommended ignoring it after every other course of action has been taken. While you're probably right in that this is a child, I don't think that makes the infringement any less malicious.

When I was learning to draw as a kid, I copied all sorts of things. I copied things I knew were copyrighted, and I knew I wasn't supposed to. I was just smart enough to only show it to my mom and not the entire internet. The point I'm getting at is this: yes, all young artists copy. Almost all of them know it's wrong. Kids that copy well-known artwork and try to pass it off like this kid know full well that it is wrong. And they either don't care or think they'll get away with it.

Which is why I don't think it's too immature to treat her as a malicious thief. She has been told that it is illegal. I'm assuming that, before she was bombarded with comments, someone politely explained to her that "referencing" EX's art is illegal. So I have no sympathy for her; let her get flamed.

I understand from the business aspect totally, like I said. She's completely right there.

But also, at the age when I started copying (again 6, 7) I really didn't know about copyright laws. I know for a fact some of the kids who went to high school with me didn't know about them, either. There are uninformed kids everywhere, kids and adults alike who don't have knowledge on your level even when you're at a younger age. Just because you knew it, it doesn't mean that everyone does. I've always been highly intelligent. When I first attended a public school, no one in my age group understood me. I knew things they didn't. And it took me a long time to understand why they didn't.

Kitty paid for/drew these (I missed which, apologies) and she has every right to want these to be removed, I would too in her position. But a grown adult bragging that she's comment flooding and harassing a maybe ten, eleven or twelve year old strikes me as way wrong. That's the kind of behavior I'd expect from the kid in this case.

The 'kid' in question says that she is about 16, I believe. So this isn't a child that doesn't understand.

^ She said she turned 16 recently, I believe. A month from turning 17.

I disagree that she was ever "bragging" about asking the art theft to take them down; that would imply she was happy and proud of it. There's also a difference between comment flooding/harassing and asking an inconsiderate theft to stop stealing your art. The theft in question was being extremely rude to everyone who asked for the stolen art to be taken down, politely or otherwise.

That is just rude. Who has the guts and even the thought of calling themselves of artists? Its pathetic and infuriating and they are too stubborn to admit their faults D8
